1. Validity of the Terms and Conditions
These Terms and Conditions apply to all business relationships between Original Food GmbH and its customers. Original Food reserves the right to amend these Terms and Conditions at any time and without providing a reason.
2. Conclusion of the Contract and Reservation of Delivery
Original Food will confirm your order via email. The contract is concluded as soon as the buyer receives the order confirmation. Original Food reserves the right to decline an order and refuse to confirm it.
Original Food reserves the right to make the delivery of orders contingent upon a credit check. By placing an order, customers consent to the collection of credit information.
Original Food may cancel or suspend an order even after the order confirmation has been sent if the customer is not creditworthy, has outstanding invoices with Original Food, or if there is reasonable suspicion of fraudulent intent.
By placing an order, the customer confirms that all information provided is accurate.
3. Prices
Prices are listed in Swiss francs (CHF) and include the statutory value-added tax. Shipping costs are billed separately (see Section 5).
Original Food reserves the right to change prices. The prices published on the website on the date of the order apply to customers.
4. Terms of Delivery
Our shipping terms apply to shipments within Switzerland and the Principality of Liechtenstein. Special terms apply to international shipments. Please contact our customer service department for more information: shop@originalfood.ch.
We usually deliver your order within 3–4 business days via standard mail to the address of your choice. If the shipping and billing addresses are different, you can enter them in your shopping cart.
Partial deliveries are possible. In such cases, Original Food will notify its customers of the delivery date for the remaining items. Original Food will cover the shipping costs for subsequent deliveries.
5. Shipping Costs for Switzerland and Liechtenstein
Shipping costs for deliveries to Switzerland and Liechtenstein are CHF 9.–. Orders totaling CHF 80.– or more qualify for free shipping. For resellers with special terms, the minimum order amount for free shipping is CHF 200.–
6. Return Policy
As a general rule, there is no right of return.
If you receive a damaged or defective item, you must report the defect in writing within 1 week of receiving the merchandise. We will replace the product or refund the purchase price as soon as the damaged or defective product is returned to us. Products returned without authorization will not be refunded.
7. Payment and Due Dates
Original Food offers its customers the following payment options:
a) Delivery on account. The invoice amount is due without deduction within 10 days of the invoice date.
b) Direct payment via your PayPal account or by credit card.
Original Food reserves the right, if necessary, to make the delivery of an order contingent upon advance payment.
In the event of late payment, a maximum of two reminders will be sent. The reminder fee for the second reminder is CHF 10.–. If payment is not made, debt collection proceedings will be initiated. The late payment interest rate is 5% starting from the first day.
8. Retention of Title
Until full payment has been made, the goods remain the property of Original Food GmbH, 6052 Hergiswil.
9. Data Protection
Your name, address, or other personal information will not be disclosed to third parties without your consent. Original Food reserves the right to disclose customer data to collection agencies in the event of unpaid bills.
10. Liability for Online Connections
Despite careful review of the content, we assume no liability for the content of external links. The operators of the linked sites are solely responsible for their content.
The provider is not liable for defects or malfunctions for which it is not responsible, particularly security breaches and service outages on the part of third-party companies with which it collaborates or on which it depends.
Furthermore, the provider shall not be liable for force majeure, improper procedures, or failure to take risks into account on the part of customers or third parties; excessive strain; unsuitable equipment used by the customer or third parties; extreme environmental conditions; interference by the customer; or disruptions caused by third parties (such as viruses, etc.) that occur despite the necessary, up-to-date security measures.
11. Legal Notice
These Terms and Conditions are governed by Swiss law. The place of jurisdiction is Hergiswil, Nidwalden.
